    Categories on which copyright can be found
    In 2008, in the Eastern Book Company vs DB Modak case, the Supreme Court said that for copyright on anything, it is necessary to have your original thought and creativity. It is not that you have written the biography of your Akbar and you get a copyright on it.

    There are only a few categories in which you can get copyright-


    Literary works – Books, poems, articles, novels, etc.
    Musical works: musical compositions or songs

    Indian copyright act in Hindi | What is copyright law?
    The 1911 Imperial Copyright Act came into existence in India. After independence, the Indian Copyright Act, of 1957 was implemented 1957. Which is also called copyright law or copyright act 1957.

    Under this law, some rights are given to the copyright owner. So that he can save his intellectual property from being stolen.

    Copyright ownership and owner's rights
    In the Copyright Act, of 1957, the copyright owner has the right to prevent others from using his works in certain ways. The Act gives two types of rights to the copyright owner:

    economic rights;
    moral right.


    The first owner of the copyright – Subject to the provisions of this Act, the person who has created any work shall be the first owner of the copyright.

    In the case of a literary, dramatic, or artistic work done by a newspaper owner in the course of his employment, that author shall be the first owner of the copyright in the work.

    However, for works performed in the course of an author's employment under a "contract of service" or apprenticeship, the employer is considered the first owner of the copyright.

    Assignment of Copyright – The copyright owner can not only use the work himself but also generate wealth by sharing it with others for mutual benefit. This can be done through the assignment and licensing of copyright.

    Only the copyright owner has the right to assign his existing or future copyrighted work in whole or in part and upon such assignment, the other person becomes entitled to all rights relating to the copyright of the assigned work and shall be deemed to be the copyright owner in respect of those rights.



    Mode of Assignment Agreement
    As per section 19, these conditions are necessary for a valid assignment:

    It must be in writing and signed;
    It should specify the type and duration of rights assigned or the territorial extent
    It should specify the amount of royalty payable in any case, if necessary.
    It has also been provided that if the period is not mentioned in the agreement, then it will be considered five years and if the territorial limit is not prescribed in the agreement, then it will be deemed to be applicable to the whole of India.







    Duration of copyright:  The term of copyright remains with the copyright owner for 60 years from the date of his death.
